These Terms & Conditions apply to the use of jack-nisbet.co.uk and to any drama facilitation or teaching services provided by me. By engaging my services, submitting an enquiry, or making a payment, you agree to the terms set out below.

2. Scope of this website

This website serves two purposes:

  1. To provide information about and facilitate enquiries for drama facilitation and teaching workshops.

  2. To act as a portfolio for my acting work.

Please note:

  • Acting work is not contracted or booked through this website.

  • Any acting enquiries are redirected to my representation.

  • I am not responsible for the terms, negotiations, or agreements made through third-party agencies.

3. Use of this website

This website is provided for informational and enquiry purposes only.

You agree not to:

  • misuse the website or attempt to gain unauthorised access to it;

  • copy, reproduce, or redistribute website content without permission;

  • submit false, misleading, or abusive enquiries or messages;

  • use the website in any way that may damage, disable, or impair its operation.

All content on this website, including text, images, and portfolio materials, is owned by or licensed to me, or used with permission, unless otherwise stated.

This includes photographs, stills, and promotional images from productions in which I have appeared. Copyright in such materials may be held by the original photographer, production company, or rights holder and is displayed for portfolio and promotional purposes only and may not be used without prior written consent.

Certain logos, trademarks, and brand names displayed on this website belong to third parties, including venues, production companies, or organisations with which I have worked or performed. These are used solely for factual identification and portfolio purposes, to indicate past professional engagements.

Such use does not imply any endorsement, partnership, sponsorship, or ongoing relationship unless expressly stated.

All third-party logos, trademarks, and brand names remain the property of their respective owners.

I do not guarantee that the website will be available at all times and reserve the right to suspend or withdraw access without notice.

4. Drama facilitation & teaching services

I provide drama facilitation and teaching services, including workshops, sessions, and related creative education work, as agreed in writing with clients.

Details such as:

  • session content

  • duration

  • location (if applicable)

  • fees

will be confirmed before work begins.

Clients must inform me in advance of any access, mobility, or other requirements so that workshops can be delivered safely and effectively.

Services are primarily delivered in Scotland, but may also be provided elsewhere in the UK or internationally by agreement.

5. Quotes and invoices

  • Quotes are provided in good faith and are valid for 14 days unless otherwise stated.

  • Invoices must be paid by the due date shown on the invoice.

  • Payments are made digitally via Squarespace Payments, which uses third-party providers such as Stripe.

All prices are listed in GBP, unless otherwise agreed.

6. Payments

  • Payment may be required in advance of delivery, particularly for workshops and one-off sessions.

  • Deposits may be requested prior to a workshop, with the remainder of the full fee payable after delivery if agreed in writing.

  • Exceptions may be made, where agreed in writing, to allow payment after a workshop has been delivered.

  • Failure to pay by the agreed date may result in cancellation or postponement of services.

  • I reserve the right to suspend services until payment is received.

7. Cancellations

Client cancellations

  • Cancellations must be made in writing.

  • If a booking is cancelled before work has begun, no further charges will be made.

  • If work has already begun or a session has been delivered, you may be charged for work completed up to that point.

Facilitator cancellations

  • If I am required to cancel a session or workshop, you will not be charged for any undelivered services.

  • Where payment has already been made, a refund or rescheduling option will be offered.

8. Refunds

Due to the nature of creative and educational services:

  • No refunds are provided once a workshop or session has taken place.

  • Where payment has been made in advance and services have not yet begun, refunds may be issued at my discretion.

  • Where a deposit has been paid:

    • If a session or workshop is cancelled by the client within 48 hours of the scheduled start, the deposit may not be refunded.

  • Any third-party transaction fees may be deducted from refunded amounts.

9. Intellectual property

Unless otherwise agreed in writing:

  • All workshop materials, session structures, and creative content remain my intellectual property.

  • Clients may not reproduce, record, or redistribute materials without prior consent.

  • I reserve the right to reference past workshops or projects for portfolio or professional purposes (no personal data will be shared).

10. Photography and recording

  • I may take photographs, video, or audio recordings during workshops for promotional, portfolio, or internal purposes.

  • Where necessary, I will provide a media release form, but clients are responsible for ensuring it is distributed to and collected from participants or their guardians prior to the workshop if photography or recordings are to be used externally (for marketing, social media, portfolio, or publication purposes).

  • Clients and participants may request that specific images or recordings not be used or be removed from promotional materials.

  • Participants will not be identified publicly without explicit consent from the participant (or parent/guardian if under 18).

  • If a client or organisation requires that no photography or recording takes place, this must be communicated in writing before the workshop.

11. Safeguarding and conduct

Where workshops involve children or young people:

  • Clients are responsible for ensuring appropriate safeguarding measures are in place.

  • I will act in a professional and appropriate manner at all times.

  • Any unsafe, abusive, or inappropriate behaviour may result in immediate termination of services.

12. Risk assessment and insurance

  • I hold appropriate public liability insurance through Equity, covering drama and acting workshops. As per Equity rules, this insurance applies to teaching or facilitating work that relates to the performing arts of my membership (e.g., drama/acting).

  • Where required, a risk assessment will be provided prior to delivery or on request.

  • Clients are responsible for ensuring that venues are safe, suitable, and compliant with all relevant health and safety regulations.

  • Clients must inform me in advance of any known risks, access requirements, safeguarding considerations, or site-specific policies that may affect delivery.

  • I am registered with the PVG scheme (Protecting Vulnerable Groups) and will comply with all safeguarding obligations when working with children or vulnerable participants.

  • I reserve the right to pause or modify activities if conditions are unsafe or unsuitable for participants.

13. Liability

To the fullest extent permitted by law:

  • I am not liable for indirect or consequential losses.

  • My total liability is limited to the amount paid for the services in question.

  • Nothing in these terms limits liability for death or personal injury caused by negligence.

  • I shall not be liable for any failure to deliver services due to circumstances beyond my reasonable control, including but not limited to natural disasters, illness, government restrictions, or venue closures. In such cases, workshops may be rescheduled or cancelled at my discretion.

  • Clients may be held financially responsible for any damage caused by participants or themselves to the venue, equipment, or materials provided for the workshop.

    • I reserve the right to invoice the client for repair or replacement costs resulting from such damage.

14. Termination

Either party may terminate an agreement with reasonable written notice. Any outstanding fees for work already completed remain payable.

15. Governing law

These Terms & Conditions are governed by and interpreted in accordance with the laws of Scotland.

Where services are provided outside Scotland, including elsewhere in the United Kingdom or internationally, the governing law may be agreed separately in writing where required.

16. Changes to these terms

These Terms & Conditions may be updated from time to time. The latest version will always be available on this website.

Client and participant personal information is collected and processed in accordance with our Privacy Policy. By booking workshops or submitting enquiries, you consent to the use of your data for the purposes of workshop delivery and administration.
